Biography
Henry Mischung has been a partner of the patent law firm Eder Schieschke & Partner mbB since 2005. He has been an authorized professional representative before the German Patent and Trademark Office since 2003 and before the European Patent Office since 2005. In addition, he is an authorized European Trademark and Design Attorney before the European Union Intellectual Property Office (EUIPO) and is an authorized representative before the Austrian Patent Office.
Practice as Attorney
Henry provides consulting services to nationally and internationally operating companies based in Germany and abroad in the entire field of intellectual property rights, particularly relating to patent and utility model law as well as trademark and design law.
His practice includes, amongst others, application and examination proceedings, particularly relating to patents, alongside (patent) opposition proceedings before the German Patent and Trademark Office and especially before the European Patent Office. He further provides consulting services in trademark and design cases. He provides support in the enforcement of protective rights in infringement proceedings or in the defense against protective rights claims, and also assists clients in strategical and other contractual matters pertaining to intellectual property rights.
Henry is a Bavarian delegate in the Federal Association of German Patent Attorneys (Bundesverband Deutscher Patentanwälte – BDPA), which has been representing the interests of German patent attorneys – particularly freelance professionals – since 1974.
On numerous occasions, he acted as a judicially appointed expert in enforcing rights to inspection. The German public-service broadcaster Bayerischer Rundfunk invited him to appear on a live show as a TV expert to discuss a trademark dispute.
Technological Background and Career
Henry studied mechanical engineering with an emphasis on process engineering at the Technical University Munich, Germany, and completed his studies with a diploma thesis on thermal comfort in cars and software development at BMW.
After additionally qualifying as an expert for environmental technologies at Siemens/Nixdorf, he gathered several years of professional experience as a project engineer at a pump producer, in an internationally operating engineering firm and in a major chemical company.
In 2000, Henry became interested in intellectual property law, which ideally complements his extensive technical experience as a practicing engineer in his view. He has been a German patent attorney since 2003. He was authorized as a representative before the European Patent Office in 2005 and has since been a partner of the law firm.
During over 20 years of practice at Eder Schieschke & Partner, his practice has included the whole range of well-known challenges of an internationally operating patent attorney. These notably comprise preparing patent and trademark applications as well as handling numerous (patent) opposition and appeal proceedings before the German Patent and Trademark Office and the European Patent Office, further providing consulting services and representation in infringement proceedings. His technical focus is on precision mechanics, machine tools, metrology, weighing technology, rolling bearings, joining technology as well as general mechanical engineering, electrical engineering and physics.
In his time off, Henry enjoys being creative in his workshop or passionately playing chess.
